Terms of Service

1. Agreement

These terms are a contract between you and ClickWebstudio Inc. (“we”, “us”), the maker of Mist & Soil. By downloading or using the Mist & Soil app or this website, you agree to them. If you do not agree, do not use the service.

2. Your account

You must be at least 13 years old to use Mist & Soil. Sign-in is handled by Apple or Google — you are responsible for keeping that account secure. Don’t share access, don’t impersonate anyone, don’t use the app to break the law or harm others.

3. Subscription & trial

• Free trial. New subscribers get a 3-day free trial. We do not charge during the trial.
• Monthly plan. US $4.99/month after the trial. Billed by Apple.
• Yearly plan. US $39.99/year after the trial. Billed by Apple.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before renewal. Manage or cancel from Settings → [your Apple ID] → Subscriptions on your iPhone.
• Refunds. Refunds are handled by Apple under their policy. We cannot issue refunds directly.
• Price changes. We may change prices for new billing cycles. We will give 30 days’ notice in the app before any change takes effect on your subscription.

4. AI Plant Doctor disclaimer

The AI Plant Doctor and identification features use machine-learning models to suggest what species your plant might be and what might be wrong with it. They are informational, not professional advice. We do not guarantee accuracy. For valuable or endangered plants, consult a horticulturist. For toxicity concerns around pets or children, consult a veterinarian or poison control — not our app.

5. Your content

You keep ownership of the plant photos, journal entries, and community posts you create. By posting publicly in the community, you grant us a limited, royalty-free license to display that content in the app and on our marketing materials (with attribution to your handle). You can delete your posts at any time, which revokes the license going forward.

6. Community rules — zero tolerance for objectionable content

There is zero tolerance for objectionable content or abusive users. By posting, commenting, or otherwise participating in the Mist & Soil community, you agree not to submit content, and not to behave in a way, that is:

• illegal, or that promotes illegal activity;
• harassing, bullying, threatening, hateful, or that targets or demeans a person or group;
• sexually explicit, pornographic, or otherwise obscene;
• violent or that incites or glorifies violence or self-harm;
• spam, scams, impersonation, or deceptive content;
• infringing on anyone else’s intellectual property or privacy.

Every user can flag any post or comment and block any user from within the app. Blocked users disappear from your feed immediately. We use automated filtering plus human review, and we remove violating content and eject offending users within 24 hours of becoming aware of a violation. We may remove content, suspend, or permanently ban accounts at our discretion, without notice. By using the service you agree to these rules; if you do not agree, do not use the community features.

7. Our content

The Mist & Soil app, brand, code, care guides, and design are ours. You may not copy, redistribute, or reverse-engineer them, except to the extent allowed by law.

8. Service availability

We aim for high uptime but do not guarantee uninterrupted service. We may take parts of the service down for maintenance, updates, or to fix security issues. AI features depend on third-party providers and may occasionally be unavailable.

9. Termination

You can stop using Mist & Soil at any time. Deleting your account (Profile → Account → Delete) terminates this agreement and removes your data per our Privacy Policy.

We may suspend or terminate your access if you breach these terms, abuse the service, or attempt to harm other users.

10. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that diagnoses, identifications, or care recommendations will be correct, complete, or current.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the greater of US $50 or the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of plants, data, profits, or goodwill.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction.

13. Changes

We may update these terms from time to time. Material changes will be announced in the app at least 14 days before they take effect. Continued use after that constitutes acceptance.
